The Depoliticization of Transitional Justice: Technical Paradigm, Selectivity, and the Construction of Peace

This article critically examines the depoliticization of transitional justice, arguing that its increasing technicization has fostered its representation as a neutral set of legal tools. Through an analysis of the technical paradigm and selected empirical cases, the article shows how prosecutorial selectivity and priority-setting are shaped by underlying power dynamics. From this perspective, transitional justice does not merely respond to past violations, but actively contributes to shaping the post-conflict order, influencing the ways in which peace is constructed.
