Abstract

The current democratic crisis can be felt on two complementary levels: from below, through the growing fear of real or imagined threats and the consequent retreat of people into the private sphere; from above, through the frequent use of suspending freedoms and the segregation, expulsion, and even extermination of segments of the population associated with these threats. All of this unfolds against the backdrop of the increasing difficulty in maintaining economic growth and the breakdown of multilateralism. In this way, conditions have been created that are conducive to the normalization of the political-legal exception, which is examined here historically and from two of its particular manifestations: the “rule-based order” and “regulatory sandboxes.” Finally, some possible future perspectives are outlined.
