El objetivo de este trabajo es, por un lado, explicar por qué el discurso sobre los Derechos Humanos permite cierto tipo de estrategias políticas insidiosas recientemente denunciadas por autores críticos con la noción de derecho humano y, por otro lado, justificar una apreciación más positiva de su función política. La tesis principal es que el discurso sobre los DDHH está en condiciones de jugar un papel fundamental para la política siempre que no asumamos que los DDHH agotan el ámbito de la justificación política. El marco para defender esta tesis es una concepción de los DDHH como cierto tipo de demandas éticas, una concepción de la dimensión retórica de la comunicación en términos de su capacidad para producir creencias y otros tipos de actitudes y una concepción de la normatividad política, i.e., el minimalismo político, según la cual la política es un ejercicio de racionalidad prudencial cuyo sujeto es una comunidad política. Según este marco, los DDHH cumplen una función política de primer orden al minimizar las ocasiones para la inconmensurabilidad de la deliberación política y el impase de la deliberación.
