The dialogue between the Constitutional Court of Romania and the European Commission in countering online election disinformation
This article enucleates the issue of countering online disinformation within electoral contexts, moving from the events that led to the annulment of Romania's December 2024 presidential election. In particular, it aims to reflect on the contribution of the Constitutional Court of Romania to the refinement of the notion of online disinformation in order to understand its potential influence on the decision-making process initiated by the European Commission under the Digital Services Act.
