Abstract

The paper deals with the proposal for a Directive “Asset recovery and confiscation” 2022/0167 (COD) proposed by the European Commission. The author provides an overview of the context in which the proposal fits, and the amendments made by the European Parliament and the Council of the European Union, currently under informal discussion between the three institutions in interinstitutional negotiations. The possible areas of concern regarding the Directive are identified on the issues of the sale of seizure assets by the State and the social reuse of confiscated assets.
